Terms and Conditions

Terms and Conditions were last revised 12th November 2011.

Definitions

Standard terms and conditions for sale of Goods of skatey.co.uk.

In this document the following words shall have the following meanings:

"Buyer" means the person who buys Goods from the Seller;

"Goods" means the articles that the Buyer agrees to buy from the Seller;

"Seller" means K. Naylor trading as skatey.co.uk of 22 Sandalwood Drive, Stafford, ST16 3FX;

"Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.

General

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

Placing an order for the Goods shall be conclusive evidence of the Buyer's acceptance of these Terms and Conditions.

Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the Seller.

Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a consumer.

Shipping

The Seller will deliver the Goods to the delivery postal address specified by the Buyer at the time of purchase. The Buyer is solely responsible for ensuring that the correct postal delivery address has been supplied. The Seller is not responsible for any Goods not received if the Buyer has supplied incomplete, inaccurate or incorrect postal address details.

The Seller will try to deliver the Goods within the estimated time shown when the Buyer purchased them. If the Seller can not deliver within the time estimated, then the Seller will contact the Buyer by email to advise of the delay.

Some Goods may not be available at the time the order is placed. In the event that the Seller is unable to deliver the Goods the time specified, the Seller will contact the Buyer by email to advise of the situation and the Buyer shall be entitled to cancel the order and receive a full refund or agree a later delivery date.

Depending upon the value of the Goods, the Seller may require that someone be present to sign for and receive the Goods. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. If nobody is present, a card will be left and the Goods will be held at a depot. Goods which are not collected from the depot within three weeks will be returned to skatey.co.uk.

If the Goods are returned to skatey.co.uk because nobody was present to receive them, or because the shipping address provided was not correct, the Buyer will be contacted by email. The Buyer may choose either:

1. Re-delivery of the Goods for an additional shipping charge identical to the original shipping cost as detailed on the Seller's shipping details page of the Seller's website.

2. A refund of the purchase cost, minus the shipping charge. An administration charge at 10% of the original total order value or £10.00 (whichever is lowest) will be deducted by the Seller from the refund balance.

If the Buyer does not respond, option 2 will be processed.

Orders shipped to a destination outside the European Union may be subject to import duties or other taxes payable by the Buyer.

Returns

Under the Consumer Protection (Distance Selling) Regulations 2000, the Buyer is entitled to cancel the order within seven days of delivery of the Goods to the specified delivery address. In order to obtain a refund under the Consumer Protection (Distance Selling) Regulations 2000, the Buyer must return the Goods to the Seller at the Buyer's expense. Goods returned must clearly show the returns number obtained from the Seller on the package. Goods returned without a returns number will not be processed.

Unless defective, customised garments (those with the text of your choice added) can not be returned for refund nor exchanged.

The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller within three working days of delivery if they are damaged or are not as specified.

If a claim of defect or damage is made, the Goods shall be returned by the Buyer to the Seller and the Buyer shall be entitled to replacement Goods or a full refund including delivery costs and any return postal charges if the Goods are upon inspection found to be defective. Goods returned must clearly show the returns number obtained from the Seller on the package. Goods returned without a returns number will not be processed.

Where returned Goods are found to be defective due to the Buyer's fault the Buyer will be liable for the cost of remedying such damage.

Colour Reproduction

The limitations of materials and technologies used in the manufacture of the Goods sold by The Seller may lead to a variation in colour between different garments. The colour settings and display hardware of your computer system may mean that there is a variation between the images shown on The Seller's web site and the actual colour shade and hue of the garment. Reasonable care has been taken to ensure that product descriptions are accurate, but specifications may change.

Product images shown on the Seller's web site are used with the consent of their respective copyright holders, the product manufacturers.

Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
